Terms & Conditions (Effective Date: 15.09.2025)

These Terms of Service & Conditions (“Terms”) govern participation in and use of the Sankat Mochan Health Programme (“Programme”). By registering, enrolling, accessing, or participating in the Programme, you agree to be legally bound by these Terms.

Legal Entity

Sankat Mochan Health Programme is an initiative of Saanvi Kalyaan Foundation Pvt. Ltd., a Section 8 Company incorporated under the Companies Act, 2013.

All contractual, financial, and legal relationships shall be exclusively with Saanvi Kalyaan Foundation Pvt. Ltd. No individual officer, employee, representative, franchisee, or associate shall be personally liable under any circumstances.

Registration Fee

The registration fee is charged toward administrative processing, MIS/LMS access, verification, inspection, onboarding, and related operational expenses.

The registration fee is strictly non-refundable once the processing of the application has commenced, irrespective of approval status, withdrawal, rejection, suspension, or termination.

The fee shall not be construed as:

• A deposit
• An investment
• A refundable security
• A partnership contribution
• A guaranteed income scheme
• Payment of the fee does not create ownership rights, profit-sharing rights, or employment status.

Authorization

Authorization under the Programme shall be granted solely at the discretion of Saanvi Kalyaan Foundation Pvt. Ltd. and only upon:

• Submission of complete and valid documentation
• Verification of office infrastructure and setup (where applicable)
• Compliance with Programme standards, policies, and operational guidelines
• Execution of required agreements (if applicable)
• The Foundation reserves the right to approve, reject, suspend, or revoke authorization without assigning any reason, in the interest of compliance, quality control, or reputation protection.

No Guarantee Clause

The Programme does not guarantee:

• MFixed income or assured earnings
• Return on investment
• Government recognition, affiliation, or endorsement unless explicitly declared in writing
• Employment or permanent association
• Medical diagnosis, treatment, or direct clinical services (unless specifically authorized under applicable law)
• Any projections, illustrations, or examples provided are indicative only and do not constitute guarantees.

Medical Disclaimer

The information provided through the Programme, website, MIS, LMS, materials, or communications is for general informational and awareness purposes only.

It is not intended to substitute professional medical advice, diagnosis, or treatment. Participants and users are advised to consult qualified medical practitioners for medical concerns.

The Foundation shall not be liable for any medical decisions made based on informational content provided under the Programme.

Dispute Resolution & Jurisdiction

All disputes, claims, or controversies arising out of or relating to the Programme shall:

First be attempted to be resolved amicably through written communication.

Failing resolution, shall be subject to the exclusive jurisdiction of competent courts at Lucknow, Uttar Pradesh, India.

Participants irrevocably submit to the exclusive jurisdiction of courts located in Lucknow, Uttar Pradesh.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

To the maximum extent permitted under applicable law:

The Foundation shall not be liable for indirect, incidental, consequential, special, or punitive damages.

Liability, if any, shall be limited to the amount of registration fee paid by the participant.

Modifications to Terms

Saanvi Kalyaan Foundation Pvt. Ltd. reserves the right, at its sole discretion, to modify, amend, or replace these Terms at any time.

In case of material changes, reasonable notice (generally 30 days) will be provided through official communication channels. Continued participation after such modifications shall constitute acceptance of revised Terms.
